NOTICE OF SUMMONS

TO: Gertie Hargrove, Erica Ryans, Lisa Robinson, Landria Odom, Evelyn Pickens, Lavon Hamilton, Audrey Rhodes, Tracy Wells, and all interested heirs of Anna Bates, deceased.

You are hereby notified that the above-styled action seeks to partition the property of Anna Bates, deceased, located in Hale County. The action further seeks to quiet title to parcel of the same property in the name of Eric Wiggins. Said action was filed against you in the Circuit Court of Hale County, Alabama, and by that reason of an order for service of summons by publication entered by the Court, you are hereby commanded and required to file with the clerk of the court and to serve upon Plaintiff’s attorney, John M. Gibbs, Gibbs & Sellers, P.C., Post Office Box 1276, Demopolis, Alabama, 36732, an answer to the Complaint within thirty (30) days after the last publication of the Notice, or default judgment will be entered against you.

THIS IS AN ATTEMPT TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.

Default having been made in the payment of the debt secured by that certain mortgage executed by Kenneth James and Patricia James, Mortgagor( s), to Commercial Credit of Alabama, Inc, Mortgagee, on July 16, 1998, said mortgage being recorded on August 4, 1998 in the Probate Office of Hale County, Alabama in Book 315, Page 261, and later assigned to U.S. Bank Trust National Association, as Trustee of Cabana Series V Trust, by reason of such default, having declared all the indebtedness secured by said mortgage due and payable, and such default continuing, notice is hereby given that, acting under the power of sale contained in said mortgage, U.S. Bank Trust National Association, as Trustee of Cabana Series V Trust will sell at public outcry, for cash, to the highest bidder, in front of the Courthouse door in the City of Greensboro, Hale County, Alabama during the legal hours of sale on May 18, 2023 the following described real estate situated in Hale County, Alabama, to wit:

THIS PROPERTY WILL BE SOLD ON AN “AS IS, WHERE IS” BASIS, WITHOUT WARRANTY OR RECOURSE, EXPRESSED OR IMPLIED AS TO TITLE, USE AND/OR ENJOYMENT AND WILL BE SOLD SUBJECT TO THE RIGHT OF REDEMPTION OF ALL PARTIES ENTITLED THERETO.

The balance of the purchase price must be paid in certified funds by noon the next business day to McMichael Taylor Gray LLC at 3550 Engineering Drive, Suite 260, Peachtree Corners, GA 30092.

McMichael Taylor Gray, LLC reserves the right to award the bid to the next highest bidder should the highest bidder fail to timely tender the total amount due. The Mortgagee/Transferee reserves the right to bid for and purchase the real estate and to credit its purchase price against the expenses of sale and the indebtedness secured by the real estate. This sale is subject to postponement or cancellation.
