Letters Testamentary upon the estate of said decedent having been granted to the undersigned on June 18, 2024, by Eldora Banks Anderson, the Probate Judge of Perry County, Alabama, notice is hereby given that all persons having claims against said estate are hereby required to present same, duly sworn to, in the Probate Court of said county within the time allowed by law, or else same will be forever barred.

NOTICE OF FORECLOSURE SALE PERRY COUNTY, ALABAMA

Default having been made in the payment of the indebtedness secured by that certain mortgage given by Daniel Malfatti and Mercedes Carreno, Husband and Wife, to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Brand Mortgage Group, LLC, dated March 16, 2016, and recorded in Book 623 at Page 303 on March 16, 2016, in the Office of the Judge of Probate of Perry County, Alabama, as last transferred to Fifth Third Bank, National Association by assignment, recorded on May 22, 2024, in Book 636, at Page 13 in the Office of the Judge of Probate of Perry County, Alabama, conveying the after-described property to secure a Note in the original principal amount of Ninety-Two Thousand One Hundred Fifty and 0/100 dollars ($92,150.00), with interest thereon as set forth therein.

Brock and Scott, PLLC, as counsel for Mortgagee or Transferee and under and by virtue of power of sale contained in the said mortgage, will, on July 31, 2024, sell at public outcry to the highest bidder for cash at the main courthouse entrance of Perry County, Alabama, within the legal hours of sale, the following described property:

To reach the point of beginning, commence at an iron rod at the intersection of the North right-of-way margin of Monroe Street and the West right-of-way margin of Centerville Street; thence run North 12 degrees 12 minutes 15 seconds West along the West right-of-way margin of Centerville Street for a distance of 358.11 feet to an iron rod for the point of beginning; thence continue North 12 degrees 12 minutes 15 seconds West along said right-of-way margin for a distance of 118.19 feet to an iron rod; thence run South 84 degrees 31 minutes 05 seconds West for a distance of 299.70 feet to an iron rod located on an existing fence line; thence run South 5 degrees 36 minutes 24 seconds East along said fence line for a distance of 118.27 feet to a fence post; thence run North 84 degrees 21 minutes 18 seconds East for a distance of 313.28 feet to the point of beginning. Said parcel lying in the Northeast Quarter of Section 12, Township 19 North, Range 7 East, Perry County, Alabama, and containing 0.8 acres, more or less.

Being and intended to be the same and identical parcel conveyed by deed of Hattie E. Whitman to E. J. Blackburn dated August 17, 1927, and appearing of record in the office of the Judge of Probate of Perry County, Alabama, in Deed Book 265 at page 285, less the parcel conveyed by deed of E.J. Blackburn and wife, Lucile W. Blackburn, to Joe M. Dozier, dated April 1, 1937, and appearing of record in the office of the Judge of Probate of Perry County, Alabama, in Deed Book 300 at page 108.

The debt secured by said Mortgage has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Mortgage. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Mortgage and by law, including attorney’s fees.

This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances, and exceptions reflected in the mortgage and those contained in the records of the Office of the Judge of Probate of the County where the above-described property is situated. This property will be sold without warranty or recourse, expressed or implied, as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.

Press Release: Immediate Release – July 2024

Marion, Alabama, June 25, 2024, — the National Park Service issued a Notification of Award confirming that the Lincolnite Club, Inc. was the recipient of a $750,000.00 grant. Funding was provided through the Historic Preservation Fund (HPF), administered by the National Park Service, U.S. Department of the Interior. Grant funds will be used to continue phase III rehabilitation of the Historic Lincoln Normal School Gymnasium. Repairs include steel structural members, repoint and clean brick, repair the concrete floor, improve drainage, repair exterior doors and prepare the building for Phase IV Building Systems replacement.

This grant is a major step toward repurposing the Gymnasium as a Multi-Purpose Community Center, highlighting the history and struggle to achieve voting and civil rights in the City of Marion, Perry County Alabama.

NOTICE TO CONTRACTORS INVITATION FOR BIDS

Sealed Bids will be received by the City of Marion until August 08, 2024, at 10:00 A.M., local time, for furnishing all labor, materials, and equipment and doing the work of constructing, according to Plans, Specifications and Contract Documents on file in the office of the Owner, the improvements hereinafter described. No bids will be received after the time set forth herein above and the Bids will be publicly opened and read. If your Bid Documents are mailed, they should be received prior to 10:00 A.M. of the Bid Date at the City of Marion 123 East Jefferson Street Marion, AL 36756.

The work of constructing City of Marion Road Rehabilitation – Rebuild Alabama Act (RAA) Grant Program will be let under one Contract. The principal items of work are detailed herein below.

Plans, Specifications, and Contract Documents are open to public inspection at the office of the Owner, City of Marion 123 East Jefferson Street Marion, AL 36756, or may be obtained from the office of the Engineers, Utility Engineering Consultants, LLC., 130 Southcrest Drive, Suite 100, Homewood, AL 35209, Phone (205) 951-3838, upon receipt of $50.00 per set, to assist in the actual cost of printing, administration; reproducing, handling, and distribution for each set of documents. No refunds will be made except to bidding Contractors, who shall be refunded for one bid set.

No Bid will be withdrawn after the time for opening has passed. The Owner reserves the right to hold the bids for a period of sixty (60) days after the date of receiving Bids. The Owner reserves the right to reject any and all bids, to waive any information in any bid, and to accept any bid considered advantageous to the Owner.

The Contractor is hereby advised that TIME IS OF THE ESSENCE on this project and that the contract time of 60 working calendar days for all areas combined and noted restrictions shall be strictly observed. LIQUIDATED DAMAGES WILL BE ASSESSED IF THE CONTRACT TIME IS EXCEEDED. The Contractor may apply for an extension of time in accordance with the provisions of the contract; however, such an extension must be approved prior to the contract completion date to avoid the imposition of liquidated damages. There will be no Pre-Bid Meeting for this Project.
